These Terms and Conditions ("Terms") govern your use of Bellavistaenid.com (the "Site"), operated by Bella Vista Estates LLC, an Oklahoma limited liability company ("Bella Vista Estates," "we," "us," or "our"). By accessing or using the Site, submitting an application, or contacting us through the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. About Us

Bella Vista Estates LLC owns residential properties in and around Enid, Oklahoma and offers certain properties for rent under lease agreements that include an option to purchase ("lease option"). We are a property owner. We are not a licensed real estate brokerage, mortgage lender, mortgage broker, credit repair organization, or financial advisor.

2. Information on This Site Is Not an Offer

All property information on the Site is provided for general information only. This includes addresses, photos, descriptions, square footage, bedroom and bathroom counts, option fees, rent amounts, purchase prices, and availability. It may change without notice and may contain errors. Nothing on the Site is an offer to rent, lease, or sell any property, and nothing on the Site creates a binding agreement.

A property is not reserved, and no rights are created, until you and Bella Vista Estates have both signed a written lease option agreement and any required payments have been received.

3. Your Written Agreement Controls

Your rights and obligations regarding any property are governed only by the written agreement(s) you sign with us. This includes the purchase price, option fee, rent, lease term, repair responsibilities, and conditions for exercising the option. If anything on the Site conflicts with a signed agreement, the signed agreement controls.

General descriptions on the Site of how lease options work, including statements about option fees, rent, or purchase terms, are summaries only. Specific terms, including whether and how any option fee is credited or refunded, are stated in your agreement.

4. No Guarantee of Approval, Financing, or Ownership

Submitting an application does not guarantee approval, a property, or any particular terms. We may approve or decline any application for any lawful reason.

A lease option gives you the right, but not the obligation, to purchase a property under the conditions in your agreement. We do not guarantee that you will qualify for a mortgage or other financing, that your credit will improve, that you will be able to exercise your option, or that the property's value will increase. Your ability to buy depends on factors outside our control, including lender requirements, interest rates, and your financial situation.

5. Not Legal, Financial, Tax, or Credit Advice

Content on the Site and communications from us are for general information only. They are not legal, financial, tax, credit, or real estate advice. You should consult your own attorney, accountant, lender, or other qualified professional before entering into any agreement. We encourage every applicant to have any lease option agreement reviewed by an attorney before signing.

6. Applications and Screening

By submitting an application, you confirm that the information you provide is true, accurate, and complete. Providing false or misleading information may result in denial of your application or termination of any agreement, as permitted by law.

With your separate written authorization, we may obtain consumer reports, including credit reports, rental history, eviction records, and background checks, from consumer reporting agencies. If we take adverse action based on a consumer report, we will provide notices as required by the Fair Credit Reporting Act.

Application fees, if any, will be disclosed before you pay and are non-refundable unless otherwise stated in writing or required by law.

7. Fair Housing

Bella Vista Estates is committed to equal housing opportunity. We will consider reasonable accommodation and modification requests from persons with disabilities as required by law.

8. Communications and Text Message Consent

When you submit a form on the Site and check the consent box, you agree to receive communications from Bella Vista Estates about your inquiry, application, properties, and related services. These may come by phone call, text message (SMS/MMS), and email, and may use automated technology, to the number and email you provide. Consent is not a condition of renting or purchasing any property.

Message frequency varies. Message and data rates may apply. Reply STOP to opt out of text messages at any time, or reply HELP for help. You may also contact us using the information below. Carriers are not liable for delayed or undelivered messages.

9. Acceptable Use

You agree not to:

use the Site for any unlawful purpose;

submit false information or impersonate another person;

attempt to gain unauthorized access to the Site or its systems;

interfere with the Site's operation, including by introducing viruses or malicious code;

scrape, copy, or collect content or data from the Site by automated means without our written permission.

10. Intellectual Property

The Site and its content, including text, photos, graphics, logos, and design, are owned by or licensed to Bella Vista Estates and are protected by copyright, trademark, and other laws. You may view the Site for personal, non-commercial use only. You may not copy, reproduce, distribute, or create derivative works from any content without our prior written permission.

11. Third-Party Links and Services

The Site may contain links to, or use services provided by, third parties, including form, scheduling, and payment providers. We are not responsible for the content, policies, or practices of third parties. Your use of third-party services is at your own risk and subject to their terms.

12. Disclaimer of Warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THIS INCLUDES WARRANTIES OF ACCURACY, COMPLETENESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES.

Any warranties or representations about the condition of a property are only those, if any, stated expressly in a signed written agreement.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BELLA VISTA ESTATES LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR RELIANCE ON ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).

This section applies to your use of the Site. It does not modify the terms of any signed lease option agreement. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Bella Vista Estates LLC and its members, managers, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising from your violation of these Terms, your misuse of the Site, or any false information you submit.

15. Governing Law and Venue

These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in or serving Garfield County, Oklahoma, and you consent to their jurisdiction.

16. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.

17. Severability and Entire Terms

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding use of the Site. They do not replace any separate signed agreement.
